Welcome to OurHangoutSpace.com. These Terms of Service ("Terms") are a binding legal agreement between you and OurHangoutSpace.com ("we," "us," "our," or the "Service"). Please read them carefully. By creating an account, accessing, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, you must not use the Service.

1. Acceptance & Changes to These Terms

By creating an account or using OurHangoutSpace.com, you agree to these Terms. We may revise these Terms at any time. When we do, we will update the "Last Updated" date above and, for material changes, provide a prominent notice on the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, your sole remedy is to stop using the Service and close your account.

2. Eligibility & Age Requirement (18+)

The Service is strictly for adults. You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to create an account or use the Service. By registering, you represent and warrant, under penalty of account termination, that you are 18 years of age or older.

We do not knowingly permit anyone under 18 to create an account or access the Service. Any account reasonably believed to belong to a person under 18 will be terminated without notice, and associated content will be removed. If you are a parent or guardian and believe a minor has created an account, contact us immediately at webmaster@ourhangoutspace.com so we can take prompt action.

You also represent that you have never previously been suspended or removed from the Service, and that you are not barred from using the Service under the laws of the United States or your jurisdiction of residence.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to: (a) provide accurate registration information; (b) keep your password secure and not share it; (c) notify us immediately at webmaster@ourhangoutspace.com of any unauthorized use or security breach; and (d) be solely responsible for all activity under your account whether or not authorized by you. We are not liable for any loss arising from unauthorized use of your account. One person may not maintain multiple accounts to evade bans, manipulate features, or abuse the token economy.

4. Content & Conduct

You are solely responsible for all content you post, upload, stream, broadcast, link to, transmit, or otherwise make available on OurHangoutSpace.com ("Content"), including text, images, video, audio, profile media, cam broadcasts, messages, and anything generated through interactive features. You represent and warrant that you own or have obtained all necessary licenses, rights, consents, and permissions to make such Content available, and that your Content does not infringe any third party's intellectual property, privacy, publicity, or other legal rights.

Prohibited Content and Conduct. You agree not to post Content or engage in conduct that:

  • Sexually exploits, endangers, or depicts any minor in any way; or that solicits, grooms, or attempts to contact a minor. This is a zero-tolerance, immediate-termination, and where applicable, law-enforcement-reporting offense.
  • Is unlawful, defamatory, fraudulent, harassing, threatening, hateful, or that promotes violence or discrimination based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or any protected class.
  • Depicts non-consensual sexual content, "revenge" intimate imagery, or any sexual content involving a person who has not given clear, knowing consent to its capture and distribution.
  • Discloses another person's private or identifying information without consent ("doxxing").
  • Constitutes spam, chain messages, pyramid schemes, or unsolicited advertising.
  • Impersonates any person or entity, or misrepresents your affiliation with a person or entity.
  • Contains software viruses, malware, or any code designed to disrupt, damage, or gain unauthorized access to any system or data.
  • Uses bots, scrapers, or automated means to access, harvest, or interact with the Service except as expressly permitted by us in writing.
  • Attempts to circumvent, disable, or interfere with security-related features, rate limits, or access controls.

We reserve the right (but assume no obligation) to review, monitor, remove, or restrict any Content or account at our sole discretion, with or without notice, for any reason including suspected violation of these Terms or applicable law.

5. Cam Rooms, Live Broadcasts & Real-Time Features

OurHangoutSpace.com offers live webcam rooms and real-time chat. By broadcasting, you consent to your audio/video stream being viewed by other users present in a room. You are responsible for everything you broadcast. Room owners and hosts are responsible for moderating their rooms and remain bound by these Terms; hosting a room does not transfer liability for the conduct of guests away from those guests, but a host who knowingly permits or encourages prohibited conduct may face account action. We do not pre-screen live broadcasts and are not responsible for the real-time conduct of users, though we will act on reports.

6. Tokens, Virtual Items & Purchases

The Service may include a virtual token economy and virtual goods (collectively "Virtual Items"). Virtual Items and tokens have no cash value, are not redeemable for money, and are not your property. They are a limited, revocable, non-transferable, non-sublicensable license to use a feature of the Service. We may manage, regulate, modify, devalue, or eliminate Virtual Items at any time, with or without notice, and we have no liability for doing so. All purchases are final and non-refundable except where required by law. Where payments are processed (e.g., via PayPal), the third-party processor's terms and privacy policy also apply.

7. Donor / Supporter Program & Donor Email Mailboxes

The Service may offer an optional paid Supporter ("Donor") membership that unlocks perks such as a badge, additional upload storage, profile customization tools, periodic token allotments, and a personal email mailbox at our domain. Membership is recurring on a 30-day cycle per payment; perks remain active while your membership term is current and lapse after the term ends (subject to any stated grace period). Donor perks are a convenience, not a guarantee of service, and may be modified or discontinued.

Donor email mailboxes. Where offered, an active Donor may claim a personal email address at our domain (for example, name@ourhangoutspace.com). The mailbox is provided as a membership perk and remains available only while your Donor membership is active. You agree to use any such mailbox lawfully and in accordance with these Terms; the prohibited-conduct rules in Section 4 apply fully to email sent or received through it. You may not use a domain mailbox to send spam, phishing, malware, unlawful, harassing, or infringing messages, or to impersonate the Service or its staff. We may suspend, disable, rename, or delete a Donor mailbox at any time, including (without limitation) when your membership lapses, upon violation of these Terms, for security or abuse reasons, or if required to operate or protect the Service. A mailbox address is licensed for your use, not sold to you, and confers no ownership of the address or its contents. We are not an email-archival service and do not guarantee retention, delivery, backup, or recovery of messages; you are responsible for keeping your own copies of anything important. On termination of your membership or account, mail stored in the mailbox may be permanently deleted.

8. Intellectual Property & License to the Platform

The Service itself, including its software, design, text, graphics, and trademarks, is owned by us or our licensors and is protected by law. By posting Content on OurHangoutSpace.com, you grant us a non-exclusive, royalty-free, worldwide, sublicensable, transferable license to host, store, cache, display, reproduce, adapt (for formatting/display), and distribute your Content solely for the purpose of operating, providing, and promoting the Service. This license ends when you delete the Content or your account, except: (a) to the extent the Content has been shared with or copied by others who have not deleted it; and (b) for reasonable backup copies retained for a limited period. You retain ownership of your Content.

9. Copyright Infringement – DMCA Compliance (U.S. Law)

We respect intellectual property rights and expect users to do the same. OurHangoutSpace.com complies with the Digital Millennium Copyright Act (17 U.S.C. § 512).

B. Notice of Infringement – Takedown Procedure

If you believe Content on OurHangoutSpace.com infringes your copyright, send a written notice to our Designated Agent including (see 17 U.S.C. § 512(c)(3)): (1) your physical or electronic signature; (2) identification of the copyrighted work(s) infringed; (3) identification of the infringing material and information reasonably sufficient to locate it (e.g., a URL); (4) your contact information; (5) a statement of good-faith belief that the use is not authorized; and (6) a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act on the owner's behalf.

C. Counter-Notice

If your Content was removed by mistake or misidentification, you may submit a counter-notice to our Designated Agent including: (1) your signature; (2) identification of the removed material and its prior location; (3) a statement under penalty of perjury of good-faith belief that removal was a mistake or misidentification; and (4) your name, address, phone number, and consent to the jurisdiction of the federal district court for your district (or the District of Connecticut if outside the U.S.), and acceptance of service of process from the original complainant. If we receive no notice of court action within 10–14 business days, we may restore the material.

D. Repeat Infringer Policy

We will terminate, in appropriate circumstances and at our discretion, the accounts of repeat infringers. A "repeat infringer" includes any user who has received two or more valid DMCA takedown notices.

E. No Liability for User Content

As a provider of interactive computer services, and provided we comply with the DMCA's notice-and-takedown provisions, we are not liable for the copyright-infringing activities of users. We do not pre-screen user Content.

10. Third-Party Services & Links

The Service may integrate with or link to third-party services (for example, PayPal for payments, YouTube for embedded media, or your hosting provider's email systems for Donor mailboxes). We do not control and are not responsible for third-party services, their content, or their practices. Your use of a third-party service is governed by that party's terms and privacy policy.

11. Termination

We may suspend or terminate your account or access to the Service, in whole or in part, with or without notice, for any violation of these Terms (including repeat copyright infringement, prohibited conduct, or suspected illegal activity) or for any reason at our sole discretion. You may close your account at any time. Upon termination: your license to use the Service ends; we may delete your Content and account data (subject to our Privacy Policy and limited backup/legal-hold retention); and any Donor mailbox and its stored mail may be permanently removed. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute terms) survive.

12. Disclaimers – No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, nor that any Content (including messages in a Donor mailbox) will be retained, delivered, or recoverable. You use the Service at your own risk.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OurHangoutSpace.com AND ITS OWNER, OPERATORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY USER CONTENT, OR ANY THIRD-PARTY CONDUCT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless OurHangoutSpace.com and its owner, operators, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of Connecticut and the United States, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Connecticut, and you consent to their personal jurisdiction, except where prohibited by applicable law.

16. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. You may not assign these Terms without our consent; we may assign them freely.
